Personal injury claims are something that many people will never have to consider. It is the legal process around claiming for an accident that was someone else’s fault.

When the time is right, reaching out to a personal injury lawyer could be a step forward in pursuing compensation.

If you have been involved in an accident and you are considering making a compensation claim, then it is likely that you have many questions.

Importantly, Andrew & Andrew solicitors operate on a ‘no win, no fee’ basis, giving our customers peace of mind alongside expert legal support.

When should I make a claim?

Most personal claims that result from injuries in the UK are subject to a three-year limitation period. Put simply, court proceedings should start within three years from the date of the accident.

In some cases, if the injury does not become apparent until after the accident, this limitation period is extended accordingly. Legally, this is known as the ‘date of knowledge’ and can be applicable in a number of situations (ie. industrial diseases that appear after exposure to an irritant or unsafe equipment eg. white finger).

However, some claims are subject to shorter limitation periods. For instance, criminal injuries and accidents outside of the UK may also have shorter limitation periods.

The accident was my fault – can I claim?

In order to claim compensation by a court, it is necessary to prove that the accident was the direct or indirect fault of another individual or organisation.

If you caused the accident due to negligence, it is highly unlikely that your claim will be successful. However, you may be able to claim compensation if the accident was partly your fault.

I was not hospitalised after my accident – can I claim?

The law states that there is no requirement to go to the hospital after an accident in order to claim compensation.

However, in order to substantiate your claim in court, you will need to provide medical evidence and therefore it is advised to see your doctor after an accident.

How much money can I claim?

Depending on your situation, the amount of money you can claim will be the result of two factors – how the accident affected your physical and psychological health and the financial loss you sustained.

Different types of injury and healing times result in different compensations. Our experienced Andrew & Andrew solicitors in Portsmouth will help you make the best claim possible.
