Insurance Policies

Insurance Disputes

Insurance disputes arise where an insurer declines to meet a claim submitted under a policy.

Cover can be declined for many reasons, those most commonly arising are issues in relation to:-

  • Policy interpretation and reliance on exclusion clauses;
  • Miss-representation and non-disclosure;
  • Breach of condition(s);
  • Precedents;
  • Breach of warranty;
  • Where fraud is alleged;
  • Contribution claims.

Insurers sometimes do not listen to members of the public; however, they become more focused when solicitors are involved. So it is prudent to instruct us as early as possible after the dispute arises to enable us to control the tempo of negotiations and to target the points in dispute under the policy.
